The https://mymetalpro.com website (the "Site") is comprised of various web pages operated by My Metal Pro LLC ("My Metal Pro"). The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site constitutes your agreement to all such Terms. Please read these Terms carefully and keep a copy for your reference.

Description of the Site

The Site provides information about, and a means to purchase, physical gold and silver bullion and collectible and numismatic coins offered by My Metal Pro. My Metal Pro is a dealer of physical precious metals. Nothing on the Site constitutes financial, investment, legal, or tax advice. Precious metals prices fluctuate, and past performance does not guarantee future results.

Purchases; Pricing; Refunds

Products sold through or described on the Site are priced against live precious metals markets, and quoted prices include the current market premium. Final pricing is confirmed at the time of sale. Privacy

Your use of the Site is subject to My Metal Pro's Privacy Policy, which also governs the Site and informs users of our data collection practices.

You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Your Account

If you use the Site with an account, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. My Metal Pro is not responsible for third-party access to your account that results from theft or misappropriation of your account.

Children Under Thirteen

My Metal Pro does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of eighteen, you may use the Site only with permission of a parent or guardian. The products offered on this site are intended for purchase by adults.

Links to Third-Party Sites and Services

The Site may contain links to other websites. The linked sites are not under the control of My Metal Pro and My Metal Pro is not responsible for the contents of any linked site. My Metal Pro provides these links only as a convenience, and the inclusion of any link does not imply endorsement by My Metal Pro of the site or any association with its operators.

Intellectual Property; No Unlawful or Prohibited Use

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms. As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site. All content included as part of the Site, such as text, graphics, logos, images, and software, is the property of My Metal Pro or its suppliers and is protected by applicable intellectual property laws. My Metal Pro and related names, marks, and logos are trademarks of My Metal Pro LLC. You agree not to modify, copy, distribute, republish, reverse engineer, or create derivative works from any Site content without express written permission from My Metal Pro.

Materials Provided to the Site

My Metal Pro does not claim ownership of the materials you provide to the Site, including feedback, suggestions, and testimonials (collectively, "Submissions"). However, by providing a Submission, you grant My Metal Pro permission to use your Submission in connection with the operation of its business, including the rights to copy, distribute, display, and reformat your Submission. No compensation will be paid with respect to the use of your Submission.

International Users

The Site is operated from the United States. If you access the Site from a location outside the United States, you are responsible for compliance with all local laws. You agree that you will not use Site content in any country or in any manner prohibited by applicable laws or regulations.

Indemnification

You agree to indemnify, defend, and hold harmless My Metal Pro, its officers, directors, employees, and agents, from and against any losses, liabilities, claims, or demands, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party. My Metal Pro reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with My Metal Pro in asserting any available defenses.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms or the Site, such dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator, and governed by the Federal Arbitration Act. The arbitration shall take place in Macon County, Missouri, or another location or remote format the parties mutually agree to. Judgment on the award may be entered in any court of competent jurisdiction. Each party shall bear its own costs and fees except as awarded by the arbitrator. The parties waive the right to a trial by jury for disputes subject to this section.

Class Action Waiver

Any arbitration or court proceeding under these Terms shall be conducted on an individual basis only, and not as a class, consolidated, or representative action. You and My Metal Pro each waive any right to participate in a class action or class-wide arbitration against the other.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. MY METAL PRO LLC MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, OR ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES CONTAINED ON THE SITE FOR ANY PURPOSE. ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY METAL PRO LLC BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF DAMAGES. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination; Governing Law

My Metal Pro reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Missouri, and, subject to the Arbitration section above, you consent to the exclusive jurisdiction and venue of the courts located in Macon County, Missouri for all disputes not subject to arbitration. If any part of these Terms is determined to be invalid or unenforceable, the remainder shall continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and My Metal Pro with respect to the Site.

Changes to Terms

My Metal Pro reserves the right to change these Terms from time to time. The most current version of the Terms will supersede all previous versions, and your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
